A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the availability of an automated external defibrillator
1-3 at high school athletic events.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter D, Chapter 33, Education Code, is
1-6 amended by adding Section 33.087 to read as follows:
1-7 Sec. 33.087. AVAILABILITY OF AUTOMATED EXTERNAL
1-8 DEFIBRILLATOR. (a) Each school district shall make readily
1-9 available an automated external defibrillator, as defined by
1-10 Section 779.001, Health and Safety Code:
1-11 (1) to each high school athletic department in the
1-12 district; and
1-13 (2) at each high school athletic practice or
1-14 competition in the district.
1-15 (b) To acquire an automated external defibrillator, to the
1-16 extent practicable a school district shall obtain federal funding
1-17 or a donation from a private organization, including a nonprofit
1-18 organization.
1-19 SECTION 2. This Act applies beginning with the 2007-2008
1-20 school year.
1-21 SECTION 3. This Act takes effect immediately if it receives
1-22 a vote of two-thirds of all the members elected to each house, as
1-23 provided by Section 39, Article III, Texas Constitution. If this
1-24 Act does not receive the vote necessary for immediate effect, this
2-1 Act takes effect September 1, 2007.
